Malaga Markets respects your privacy. This policy explains what personal information we collect, why we collect it, how we look after it, and how you can access or correct it.
In this policy, “Malaga Markets”, “we”, “us” and “our” mean SALIN INVESTMENTS PTY LTD ATF ASLIN TRUST 2 – ABN: 52 262 772 709 the operator of Malaga Markets at 7 Bonner Drive, Malaga WA 6090.
This policy covers personal information we collect through our website (malagamarkets.com.au), our social media pages, by phone and email, and at the market itself. We handle personal information in line with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth).
Individual shops, stalls and food vendors at Malaga Markets are independent businesses. When you deal with them directly, their own privacy practices apply.
WHAT PERFONAL INFORMATION WE COLLECT
We only collect information we reasonably need. What we collect depends on how you deal with us.
You can make a general enquiry without giving your real name. We may not be able to help with bookings or leasing unless you identify yourself.
We do not intend to collect sensitive information, such as health or religious information. If you tell us about a dietary or accessibility need, we use it only to help with your visit or booking.

HOW WE COLLECT IT
We collect most personal information directly from you, for example when you:
- fill in a contact, leasing, pop-up or booking form on our website
- call, email or message us, including through social media
- sign a lease or stallholder agreement
- report an incident or lost property at the market.
We also collect information automatically through our website (see Cookies and analytics) and through CCTV cameras at the market. Signs at the entrances and in the car park tell you where CCTV is in use.
Sometimes we receive information from others, such as a tenant who lists you as a staff contact, or a referee you have named. If we receive information we did not ask for and do not need, we will destroy or de-identify it where lawful and reasonable.
WHY WE COLLECT AND USE IT
We use personal information to run the market and deal with you. This includes to:
- answer your enquiries and give you information you ask for
- manage quiz night and event bookings
- assess leasing and pop-up applications, and manage leases, stall allocations, invoicing and payments
- keep visitors, tenants and staff safe, protect property, and investigate incidents
- meet our legal, insurance, food safety and tax obligations
- improve our website, events and services
- send you news and offers, if you have agreed to receive them.
We only use your information for another purpose if you would reasonably expect it, you agree, or the law allows or requires it.
We do not use automated decision-making (including AI tools) to make decisions that significantly affect your rights or interests, such as whether a leasing application is approved. Those decisions are made by our staff.
COOKIES AND ANALYTICS
Our website uses cookies, which are small files stored on your device. Some are needed for the site to work, such as keeping forms working. Others help us understand how people use the site, for example through Google Analytics.
Analytics data is generally collected in aggregate and does not tell us who you are. Our website may also include embedded content from other services, such as Google Maps, YouTube, Facebook or Instagram. Those services may set their own cookies under their own privacy policies.
You can block or delete cookies in your browser settings. Some parts of the site may not work properly if you do. You can opt out of Google Analytics using Google’s browser add-on at tools.google.com/dlpage/gaoptout.
DIRECT MARKETING
We will only send you marketing emails or SMS messages, such as event news and offers, if you have agreed to receive them or would reasonably expect them.
Every marketing email or SMS includes a simple way to unsubscribe. You can also opt out at any time by emailing info@malagamarkets.com.au. We will act on your request within 5 business days, free of charge.
We never sell your personal information.
WHO WE SHARE IT WITH
We may share personal information with:
- service providers who help us run the market and website, such as web hosting, email, booking, accounting and IT providers
- our security contractors, insurers, lawyers and accountants
- property owners or managers of the site, where needed to manage leases
- WA Police or other authorities, for example CCTV footage relating to a crime or incident, or where the law requires it.
We require our service providers to protect your information and use it only for the services they provide to us.
Some of our service providers, such as cloud email, website and analytics providers, may store data outside Australia, including in the United States. Where this happens, we take reasonable steps to make sure your information is handled in a way that is consistent with the APPs.
HOW WE STORE AND PROTECT IT
We store personal information in secure electronic systems and, for some records such as signed leases, in locked paper files. We take reasonable steps to protect it from misuse, loss, and unauthorised access or disclosure. These steps include password-protected systems, limiting access to staff who need it, and securing our office.
CCTV footage is kept for about [30] days and then overwritten, unless we need it to investigate an incident or give it to police.
We keep other information only as long as we need it for the purposes in this policy or as the law requires. For example, we keep financial and lease records for at least 7 years for tax purposes. After that, we securely destroy or de-identify it.
No system is completely secure. If a data breach is likely to cause you serious harm, we will tell you and, where required, the Office of the Australian Information Commissioner (OAIC).
ACCESSING, CORRECTING AND COMPLAINTS
You can ask to see the personal information we hold about you, or ask us to correct it if it is wrong, out of date or incomplete. Contact us using the details below. We will need to confirm your identity first.
We will respond within 30 days. We do not charge for making a request. If we refuse, we will tell you why in writing, unless that would be unreasonable, and how to complain. For CCTV, we may be unable to give you footage if it would affect other people’s privacy or a police investigation.
If you think we have breached your privacy, please contact us first and describe what happened. We will acknowledge your complaint within 7 days and aim to resolve it within 30 days.
If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
